Terms of Service

These Terms of Service ("Terms") govern your use of the Klada mobile application ("the App"), operated by Domagoj Blazonija ("we", "us", or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be 18 years of age or older to use Klada. By using the App, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts found to belong to users under 18.

2. What Klada Is

Klada is a social bet-tracking application for use between friends. It allows users to create, track, and resolve friendly wagers.

Klada does not involve real money. No currency, tokens, or items of real-world monetary value are wagered, transferred, or won through the App. Bets are resolved through prestige points and trophies that exist solely within the App and have no monetary value.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate information when creating your account.
You may not create multiple accounts or use another person's account.

4. Acceptable Use

You agree not to use the App to:

Harass, bully, or threaten other users
Post illegal, obscene, or offensive content in bets or messages
Impersonate another person or entity
Attempt to gain unauthorized access to other accounts or our systems
Use the App for any commercial purpose
Violate any applicable local, national, or international law

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

5. User-Generated Content

You retain ownership of content you submit (text, images, audio). By submitting content, you grant us a limited license to store and display it to other participants of the same bet.

You are solely responsible for the content you submit. We are not liable for content created by users.

6. Intellectual Property

The Klada name, logo, and app design are the property of Domagoj Blazonija. You may not copy, modify, or distribute any part of the App without our written permission.

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or free of harmful components. Your use of the App is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Domagoj Blazonija shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the App shall not exceed €50.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us at privacy@domagoj.fyi.

10. Governing Law

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Croatia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
